Agreement to these Terms
These Terms of Service govern your use of sell.diabeticbuybackprogram.com and any sale you make to XBC Group LLC, a Colorado limited liability company operating the Diabetic Buyback Program, referred to here as the Company, we, us, or our. By requesting an offer, sending us supplies, or otherwise using this site, you agree to these terms. If you do not agree, please do not use the site or send us supplies.
1. Who can sell to us
You must be at least 18 years old and the sole legal owner of any supplies you send us. By sending us supplies, you make the following promises to us:
- You are the legal owner of the supplies and have full authority to sell them.
- The supplies were never billed to a government program, including Medicare, Medicaid, the VA, Tricare, or the Indian Health Service.
- The supplies are sealed, unopened, and not expired.
- The information you give us about the supplies, including brand, quantity, and expiration date, is accurate and complete.
If any of these statements turns out to be false, we may reject the shipment, withhold payment, and where required by law, report the matter to the appropriate authorities.
2. Eligible supplies
We buy over the counter blood glucose test strips and continuous glucose monitor sensors that are sealed, unopened, and unexpired, in their original manufacturer retail packaging. We do not buy everything. The following are never eligible, regardless of condition:
- Prescription drugs of any kind
- Insulin
- GLP-1 medications
- Controlled substances
- Any supply billed to a government program, including Medicare, Medicaid, the VA, Tricare, or the Indian Health Service
- Anything opened, expired, or damaged
If you send us anything on this list, we will not purchase it and will handle it as described in section 6.
3. Offers and how they are calculated
We price offers using the brand, quantity, and expiration date of the supplies you tell us about, along with current market conditions for sealed diabetic testing supplies. The offer you see before you ship is an estimate based on the information you give us. Your final payment is based on what our team verifies when your shipment checks in, not on that estimate. Offers may change if the supplies received do not match the description given, including differences in brand, quantity, condition, or expiration date.
4. Return shipping and prepaid labels
Shipping to us is inbound only. You ship your supplies to us. We do not sell at retail and we do not ship product to consumers. The only thing that ever goes back out is a seller's own property that we could not buy. Once you accept an offer, we generate a prepaid UPS Ground label for you through Shippo, a multi-carrier shipping platform. You are responsible for packing your supplies securely and getting your shipment to UPS. We are not responsible for supplies lost or damaged in transit before they reach our facility, though we will work with the carrier on your behalf if a shipment does not arrive.
5. Inspection and payment
When your shipment arrives, our team inspects the contents against what you told us. If everything matches, we finalize payment the same day the shipment checks in. Payment is issued through the method you selected at intake.
6. Rejected items
If any part of your shipment does not meet our eligibility rules, including anything opened, expired, damaged, or on the prohibited list in section 2, we will not pay for that portion of the shipment. Depending on the item, we may return it to you at our discretion, or where the law requires proper handling, such as with prescription drugs or controlled substances, dispose of it accordingly. We will always tell you what we rejected and why.
7. Prohibited transactions
We will not purchase, and you agree never to send us, any of the following: prescription drugs, insulin, GLP-1 medications, controlled substances, or any supply billed to a government program such as Medicare, Medicaid, the VA, Tricare, or the Indian Health Service. Sending us prohibited items may result in a rejected shipment, withheld payment, and reporting to the appropriate authorities where required by law.
8. Payment methods and tax reporting
We pay by the method you choose at intake. Where required by federal law, payments to sellers are reported on Form 1099-K when the applicable dollar and transaction thresholds are met. You are responsible for reporting any income from your sales to us on your own tax filings. We recommend keeping your own records of what you send us and what you are paid.
9. Privacy
Our collection and handling of your personal information is described in our Privacy Policy at sell.diabeticbuybackprogram.com/privacy, which is part of these terms.
10. Limitation of liability
To the fullest extent permitted by law, the Company is not liable for indirect, incidental, or consequential damages arising from your use of this site or your sale of supplies to us. Our total liability to you for any claim will not exceed the amount we paid you for the shipment giving rise to the claim.
11. Governing law and dispute resolution
These terms are governed by the laws of the State of Colorado, without regard to conflict of law rules. Any dispute arising from these terms or your sale to us will be resolved through binding arbitration in Denver, Colorado, except that either party may bring an individual claim in small claims court in Adams County, Colorado.
12. Changes to these terms
We may update these terms from time to time. The date at the top of this page shows when the terms were last updated. Continuing to use the site or sending us supplies after an update means you accept the revised terms.
